1. Our Contract

These Terms and Conditions govern the supply of goods sold by

Western Counties Wholesale, Unit 12, 2A Barton Hill Road , Torquay, Devon , TQ2 8JH ("we" and "us") to the customer named on the order form provided on the Western Counties Wholesale website ("you"). Together with the completed order form, these Terms and Conditions constitute the entire and only agreement between us in relation thereto. Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us on these terms and conditions.

2. Price & Payment

2.1 The price payable for the goods you order is as set out on our website at the time you place your order, plus any charges for carriage as set out in the order form.

2.2 Subject to clause 2.3, we must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage, before your order can be accepted unless we have agreed otherwise in advance in writing.

2.3 if you fail to make full payment when due, we reserve the right to charge interest, payable at the rate of 3 per cent over Royal Bank Of Scotland's then current base rate on the amount outstanding from the due date for payment until receipt by us of the full amount (including any accrued interest) whether before or after judgement , together with any reasonable legal or other recovery costs.

3. Delivery & Title

We use ANC/FEDEX 24 Hour service for our deliveries. Parcels for UK Mainland and Isle of Wight are delivered using the 24 hour service (this is not guaranteed). If your parcel is small and lightweight it will be sent by ANC 24 hour easipack. All items are traceable.
Parcels to Highlands and Islands, Isles of Scilly, Isle of Man, Northern Ireland (up to 10kg) are sent by 72 hour service or by Royal Mail if cheaper. All good dispatched are subject to the relevant carriers terms and conditions. If you do not receive delivery in 7 days you must notify us immediately. Items are normally dispatched within 2-3 days of receipt of order..

4. Availability

While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered, you will not be charged for these items.

5. Cancellation & Returns

Our Returns Policy

We endeavour to supply only the highest quality product, however, if for any reason you wish to return a product, all purchases are covered by our 7 day exchange or refund promise. You must notify our office within 7 days if you wish to return any items. If you return the product in its original condition including labels & packaging, we will refund you any money that you have paid us for that product, or replace with an item of the same value.

If you are returning an item because of an error on our part or because it is damaged or defective, we will refund your costs of returning it to us. Please contact us on how to return items to us.

Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective. If there has been no error on our part, we will refund only the cost of the item

 Your Statutory Rights

By law, customers in the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered. Our Refunds Policy

When you send your item back to us, we'll process the returned item then notify you via e-mail of your refund. You can expect a refund in the same form of payment originally used for purchase within four weeks of our receiving your return.

6. Liability

If you have notified us of a problem with the goods, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.

We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

7. Force Majeure

We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

8. General

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.

9. VAT

All prices exclude VAT at 20% where applicable.

10. Minimum Order

The minimum order is £50

11. Bank Charges

We reserve the right to pass on to the customer any bank charges incurred due to non-clearance of cheques or charge backs of credit cards.
